Under the authority of section 61 of the Automobile Insurance Act and subsection 3.1(8) of the Insurance Companies Act, the Lieutenant-Governor in Council is pleased to appoint Dennis Browne, Q.C., as Consumer Advocate for automobile insurance matters, including representing consumers during the upcoming Board of Commissioner of Public Utilities’ review of automobile insurance, effective from a current date, for a term of 18 months, subject to the following terms and conditions:

a) the term of appointment may be extended for up to six months with the approval of the Minister of Service Newfoundland and Labrador;

b) specific project assignments for which the Consumer Advocate will be paid will be approved, in advance, by the Minister of Service Newfoundland and Labrador;

c) remuneration for the Consumer Advocate shall be set at $225 per hour, up to a maximum of 12 hours in any one day;

d) subject to prior approval of the Minister of Service Newfoundland and Labrador, the Consumer Advocate may retain such experts and consultants as may reasonably be required, for the purpose of carrying out his duties;

e) the Consumer Advocate shall submit a budget to the Minister of Service Newfoundland and Labrador outlining the particulars and estimated costs which may be reasonably anticipated in the performance of his duties. If, at any time, it would appear that the anticipated costs will be exceeded, a revised budget shall be submitted; 

f) the Consumer Advocate is to prepare a summary report on his activities and associated costs and provide same to the Minister of Service Newfoundland and Labrador at the end of each fiscal year, commencing April 2018; and

g) the Consumer Advocate is directed to prepare and file a report with the Minister of Service Newfoundland and Labrador, in a form satisfactory to the Minister, outlining the details of the expenses incurred and the work performed within 45 days after the date of an order of the Public Utilities Board or an order of the court upon appeal of the Public Utilities Board order or a report of the Public Utilities Board following a review, with such report to be submitted to the House of Assembly by the Minister of Service Newfoundland and Labrador within 15 days of receipt if the House of Assembly is sitting or if the House of Assembly is not sitting, within 15 days of the opening of the House of Assembly.
