Under the authority of section 4.1 of the Public Utilities Act and section 5.2 of the Electrical Power Control Act 1994, the Lieutenant Governor in Council is pleased to exempt from the respective pieces of legislation a project defined as (i) Newfoundland and Labrador Hydro’s continued payments under the abrogated power purchase agreements with the Exploits River Hydro Partnership and the Star Lake Hydro Partnership for power deliveries from 16 December 2008 to 12 February 2009; and (ii) Newfoundland and Labrador Hydro’s negotiation, execution and performance of a power purchase agreement with Nalcor Energy–Generation for the purchase of electricity generated from the former Abitibi-Consolidated power generation assets, which agreement will expire no later than February 28, 2010.
