Under the authority of section 53(1) of the Lands Act, the Lieutenant Governor in Council is pleased to authorize the Minister of Environment and Conservation and the Minister Responsible for Aboriginal Affairs to transfer the administration and control of the Crown land situated at Sheshatshiu in the Electoral District of Lake Melville as more particularly described and delineated as the “Provincial Crown Lands” in Schedule “E” of the Sheshatshiu Land Transfer Agreement, to Her Majesty the Queen in Right of Canada, subject to the following limitations and conditions: 

 

i)  The land shall be used for the purpose of establishing a Reserve for the Sheshatshiu Innu under the Indian Act (Canada)pursuant to the terms and conditions of the Sheshatshiu Land Transfer Agreement,

 

ii)  excepting and reserving nevertheless to Her Majesty the Queen in Right of Newfoundland and Labrador all minerals, limestone, granite, slate, marble, gypsum, marl, clay, sand, gravel, building stone, volcanic ash, peat, coal, natural gas, naturally occurring oil and salt, and all minerals as defined by the Minerals Act; all quarry  materials as defined by the Quarry Material Act; petroleum defined by the Petroleum and Natural Gas Act; stratified deposits other than coal from which oil can be extracted by destructive distillation; and all historic resources within the meaning of paragraph 2(e) of the Historic Resources Act, whether in or under the Provincial Crown Lands, and

 

iii)  if the land or any part thereof is not subsequently set apart as a Reserve under the Indian Act (Canada), the administration and control thereof shall be conveyed back to Her Majesty the Queen in Right of Newfoundland and Labrador as provided for under the Sheshatshiu Land Transfer Agreement.
