Under the authority of section 7 of the Fishery Products International Limited Act, the Lieutenant Governor in Council hereby approves the sale of the Harbour Breton plant and machinery and equipment located therein, from FPI Limited/Fishery Products International Limited to the Barry Group of Companies Inc. or associated or affiliated companies (hereinafter “Barry Group”), subject to an agreement being executed between the Town of Harbour Breton and the Barry Group in a form satisfactory to the Minister of Fisheries and Aquaculture which includes amongst its terms and conditions the following:

i) the Harbour Breton plant and machinery and equipment therein shall revert to the Town of Harbour Breton should the Barry Group cease operations at the facility; and

ii) all applicable occupational health and safety and environmental considerations are to be addressed before the plant becomes operational.
