Under the authority of section 96 of the Workplace Health, Safety and Compensation Act, the Lieutenant Governor in Council hereby authorizes the Workplace Health, Safety and Compensation Commission to adopt the Newfoundland and Labrador Construction Safety Association Certificate of Recognition Program as the Part I criteria for the construction industry under the Commission’s new Experience Rating Program called PRIME, subject to:

  i)  the Certificate of Recognition Program is to be phased-in over a three-year period beginning January 2005;

 ii)  an agreement is to be signed between the Commission and Association, whereby the Association is required to obtain the approval of the Commission to change any element or standard of the Certificate of Recognition Program; and

iii)  any additional costs for audit functions to be performed by the Commission resulting from the adoption of the Certificate of Recognition Program are to absorbed within the Commission’s existing budgetary allocation.
