Under the authority of section 8 of the Endangered Species Act, the Lieutenant Governor in Council hereby authorizes the Minister of Environment and Conservation to not list the Mountain Holly Fern (Polystichum scopulinum) as threatened on the basis that no designation should be approved unless and until the existence of the Mountain Holly Fern (Polystichum scopulinum) in Newfoundland and Labrador is firmly established.
