Energy Corporation Act
Under the authority of subsection 4(1) and section 12.1 of the Energy Corporation Act
and subsections 245(1), 245(2), and 245(8) of the Corporations Act, the Lieutenant-
Governor in Council is pleased to direct the Board of Directors of Nalcor Energy
(“Nalcor”), notwithstanding the terms and conditions of employment, compensation
plan, or contract, to:
a) take such steps as are required to eliminate all performance-based pay policies
and incentive programs, starting in 2021, for persons not represented by a
bargaining agent certified or recognized under an Act of the province, including
executive, officers, managers, other staff and employees, and independent
contractors of Nalcor and its subsidiaries, effective immediately;
b) not take any actions whatsoever with respect to increases in compensation or
remuneration of persons that are not represented by a bargaining agent certified
or recognized under an Act of the province, including executive, officers,
managers, other staff and employees, and independent contractors of Nalcor and
its subsidiaries, until further advised by the Lieutenant-Governor in Council;
c) find savings to reduce the operating budget of Nalcor and its subsidiaries
equivalent to the amount of the performance-based payments owing for the 2020
calendar year for persons employed by Nalcor, the Newfoundland and Labrador
Hydro-electric Corporation (“Hydro”), and their respective subsidiaries, and to enusre no
impact on Hydro’s budget, effective immediately; and,
d) provide the Minister of Industry, Energy and Technology with all information
and documents he may request, within the timeframes specified by the Minister,
regarding Nalcor’s employment contracts, compensation policies, organizational
structure, or any other information and documents the Minister determines
necessary.
