Under the authority of section 53 of the Lands Act, the Lieutenant Governor in Council is pleased to authorize the Minister of Environment and Conservation to amend, retroactive to March 29, 2013, Transfer No. 93855 issued on April 29, 1991, to Her Majesty the Queen in Right of Canada, by deleting the conditions “1) the land shall at all times be used for maring purposes including breakwater and wharf” and “3) if and as soon as the said land ceases to be used for the purpose mentioned in (1) above, the administration and control thereof shall thereupon be assumed by Her Majesty the Queen in Right of Newfoundland” and substituting the condition “1) Her Majesty the Queen in Right of Canada is permitted to divest itself of the lands contained in this Transfer, only if the lands are conveyed to the Long Pond Harbour Authority Inc. and the Long Pond Harbour Authority Inc. cannot divest itself of this property without the consent of Her Majesty the Queen in Right of Newfoundland and Labrador and the area continues to be used for the purpose of a public wharf, including breakwater”.
