Workplace Health, Safety and Compensation Act
Under the authority of section Section 126 of the Workplace Health, Safety and Compensation Act, the Lieutenant Governor in Council is pleased to set the terms of reference for a Statutory Review of the Workplace Health, Safety and Compensation Act to be undertaken in two phases, as follows:
i) Phase One is to commence immediately upon the appointment of committee members and consist of a legislative examination which shall review, consider, report and make recommendations to the Lieutenant-Governor in Council upon matters respecting this Act, including (a) enhancements based upon a jurisdictional and best practices review of workers’ compensation legislation elsewhere in Canada, including provisions for the statutory review process itself; (b) a gender-based analysis of the legislation; (c) the identification of any potential errors, anomalies or omissions; and (d) opportunities to consolidate the legislation from a red tape reduction perspective and improve its overall readability;
ii) Phase Two is to commence following the completion of Phase One and shall review, consider, report and make recommendations to the Lieutenant-Governor in Council upon matters respecting the Regulations, the administration of the Act and Regulations as the committee considers appropriate and upon other matters which the Lieutenant-Governor in Council or the Minister refer, including the themes of Occupational Disease, Claim Benefit Ceiling, Labour Market Re-entry, Medical Management, Prevention– Role of Stakeholders, and Financial Sustainability;
iii) Phase One of the Statutory Review is to be completed no later than Fall 2011; and
iv) Phase Two of the Statutory Review, to be completed by Spring 2012, is to commence following the completion of Phase One.
