Further to the direction in OC2008-004 and under the authority of section 6 of the Public Utilities Act, the Lieutenant Governor in Council hereby provides as follows:

i) during his term as full-time Commissioner, Chairperson and Chief Executive Officer of the Board of Commissioners of Public Utilities, should Mr. Wells require sick leave over and above the annual leave allowable under the Executive Compensation Plan Policies and Procedures approved by MC91-0016, then the pension payments of $24,520 per year payable to Mr. Wells under “The Board of Commissioners of Public Utilities (Commissioners’) Pension Regulations, 1967,” that are currently discontinued, would be reinstated on a pro rata basis for the duration of the sick leave; and  

ii) at the conclusion of his term as full-time Commissioner, Chairperson and Chief Executive Officer of the Board of Commissioners of Public Utilities, the pension payments of $24,520 per year payable to Mr. Wells under “The Board of Commissioners of Public Utilities (Commissioners’) Pension Regulations, 1967,” will be reinstated.
