Under the authority of sections 63, 72 and 73 of the Environmental Protection Act and section 7 of the Intergovernmental Affairs Act, and upon the advice of the Minister of Environment and Conservation, the Lieutenant Governor in Council is pleased to:

                                       i) authorize the Minister of Environment and Conservation and the Minister for Intergovernmental Affairs to enter into an “Agreement Concerning The Establishment of a Joint Review Panel for the Environmental Assessment of the Lower Churchill Hydroelectric Generation Project,” with the Government of Canada, substantially along the lines of the copy on file with the Clerk of the Executive Council;

                                       ii) authorize the Minister of Environment and Conservation and the Minister for Intergovernmental Affairs to establish a Joint Review Panel with the Government of Canada to carry out an environmental assessment of the Lower Churchill Hydroelectric Generation Project in accordance with the said agreement; and

                                      iii) order public hearings relating to the environmental assessment of the Lower Churchill Hydroelectric Generation Project, with the conduct of such hearings to be in accordance with the process outlined in the said Agreement.
